These terms govern your use of the kervalta.io website (the "site"), operated by Kervalta Software Systems ("Kervalta", "we", "us"). This is an informational site about our company and our products. By using it, you agree to these terms. If you do not agree, please do not use the site.
This site is informational
The site exists to tell you who Kervalta is and what we build. Nothing on it is an offer, a contract, a quote, or professional advice, and nothing you read here creates a business relationship or any obligation on our part. Product descriptions are provided to inform, and may change as the product evolves.
uptrack has its own agreement
uptrack is our software product and is provided under a separate agreement between Kervalta and each customer. Reading about uptrack here does not grant you any right to use it and is not that agreement. Access to the uptrack application at uptrack.kervalta.io is governed by the terms presented there.
Intellectual property
The site and its contents — text, design, layout, code, graphics, logos, and the uptrack and Kervalta names and marks — are owned by Kervalta or used with permission and are protected by copyright and trademark law. You may view and share links to the site, but you may not copy, reproduce, republish, or create derivative works from its content without our written permission, except as normal browser use and personal reference require.
Acceptable use
You agree not to:
- use the site for any unlawful purpose or in violation of these terms;
- attempt to gain unauthorized access to the site or its underlying systems;
- interfere with or disrupt the site, including by overloading or probing it; or
- scrape or harvest content in a way that burdens the site or misrepresents its source.
Links to other sites
The site may link to third-party sites and services we do not control, such as our LinkedIn page or the uptrack application. We provide those links for convenience and are not responsible for the content, policies, or practices of any third-party site. Following a link is at your own risk.
No warranty
The site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to accuracy, reliability, availability, or fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free, and we may change, suspend, or discontinue any part of it at any time.
Limitation of liability
To the fullest extent permitted by law, Kervalta will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from your use of — or inability to use — the site. Nothing in these terms limits liability that cannot be limited under applicable law.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts located in Ontario will have jurisdiction over any dispute arising from these terms or your use of the site.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the "last updated" date above. Your continued use of the site after a change means you accept the updated terms.
